The USDA has proposed sweeping changes to the Agricultural Foreign Investment Disclosure Act (AFIDA) regulations that would dramatically expand who must report, what must be reported, and how much is at stake for noncompliance. This webinar will walk attendees through the key provisions of the proposed rule, including:
- A broadened definition of "ownership" capturing land with as little as 10% direct or indirect foreign ownership or beneficial control
- An expanded definition of "agricultural land" now encompassing wind and solar projects, pipeline and transmission easements, warehouses, agricultural storage facilities, and agricultural R&D operations
- New geospatial mapping requirements tied to land use allocations
- Elimination of the 10-acre de minimis threshold and reduction of the lease-term exemption to as short as one year
- A sharp increase in late-filing penalties — from 0.1% to 1.5–2.5% of fair market value per week — enforced through the USDA's Office of Homeland Security with no discretion for mitigation
- Retroactive application requiring reassessment of existing portfolios, with a 90-day compliance window once the rule is finalized (targeted for December 2026)
Whether you manage farmland, appraise rural properties, or advise landowners on transactions involving foreign investment, these proposed rules could reshape your compliance landscape. Join this session to understand the practical impact and prepare ahead of finalization.
