House Releases Tax Cut and Jobs Act

Last week House Ways and Means Chairman Brady (R-TX) released the House plan to cut taxes. The bill is called the Tax Cut and Jobs Act and will be marked up in the Ways and Means Committee this week with the goal of passing the bill in the House before Thanksgiving. The Senate Finance Committee may release its version this week. Highlights from the House bill include:
Collapses personal tax brackets from 7 to 4 (12%, 25%, 35%, 39.6%), with a doubling of the standard deduction, and an increase of child and dependent tax credits.

Phases out the Estate Tax after 2023, with an immediate doubling of the exemption, while fully maintaining stepped up basis.

Repeals the Alternative Minimum Tax (AMT)

For businesses, rates for Corporations (including C corps) are moved to a 20% flat rate and pass through business income (via partnerships, LLCs, Sub S, etc.) is taxed at 25%.

Cash basis accounting for agriculture is maintained.

Interest deductibility for businesses is maintained but restricted to those with less than $25 million in annual revenues.

Section 179 is maintained and increased to a $5 million limit.

Section 1031 like kind exchanges are maintained, but for real property only.

AQB Issues Fourth Exposure Draft of Proposed Changes to the Real Property Appraiser Qualification Criteria

The Appraisal Qualification Board (AQB) recently released an exposure draft with proposed changes to the Real Property Appraiser Qualifications Criteria. Comments are due by January 12, 2018. The AQB will also accept verbal comments at its public meeting in Washington, DC on Thursday, February 1, 2018. 
Areas proposed for changes include:

Degree Requirement for Licensed Residential and Certified Residential: Section 1 of this document addresses college-level education requirements for the Licensed Residential and Certified Residential classifications.

Alternative Track for Licensed Residential to Certified Residential: Section 2 of this document outlines a pathway for qualified Licensed Residential appraisers to obtain a Certified Residential credential without satisfying the college-level education requirements. 
Practical Applications of Real Estate Appraisal: Section 3 of this document outlines the status of the Practical Applications of Real Estate Appraisal concept.

Experience Requirements: Section 4 of this document contains proposed revisions to the experience hours and time frames required for the Licensed Residential, Certified Residential, and Certified General classifications.

USDA Secretary Perdue Announces Farm Service Agency and Rural Development State Directors

USDA Secretary Sonny Perdue announced a slate of Farm Service Agency (FSA) and Rural Development (RD) State Directors, all serving as appointees of President Donald J. Trump. FSA State Directors help implement U.S. Department of Agriculture (USDA) policies in planning, organizing, and administering FSA programs in their respective states. They are also responsible for running the day-to-day activities of the state FSA office. Similarly, RD State Directors work to help improve the economy and quality of life in rural America.

Voting Begins for Farm Service Agency County Committees

The USDA will begin mailing ballots to eligible farmers and ranchers across the country for the 2017 Farm Service Agency (FSA) county committee elections on Monday, Nov. 6, 2017. To ensure their votes are counted, producers must return ballots to their local FSA offices by Dec. 4, 2017. Nearly 7,700 FSA county committee members serve FSA offices nationwide. Each committee has three to 11 elected members who serve three-year terms of office. One-third of county committee seats are up for election each year. County committee members apply their knowledge and judgment to help FSA make important decisions on its commodity support programs, conservation programs, indemnity and disaster programs, and emergency programs and eligibility.

Producers must participate or cooperate in an FSA program to be eligible to vote in the county committee election. Approximately 1.7 million producers are currently eligible to vote in this year’s election.

FY 2018 Congressional Budget Resolution Set

After the Senate passed its FY 2018 budget the week of 10/16, the House narrowly passed the Senate version the week of 10/23 rather than insisting on a conference. The House vote of 216 – 212 was a party-line vote with 20 Republicans joining all Democrats voting “No.” The budget resolution does not require a Presidential signature. The Congressional Budget Resolution sets up budget reconciliation procedures for a tax reform package, with up to $1.5 trillion in additional deficit spending for tax reform. The Budget does not require any cuts to agriculture spending programs, so the House and Senate Agriculture Committees can write the farm bill at current spending levels. Recall the 2014 farm bill was believed to save $23 billion at the time of passage, which has since resulted in over $100 billion in actual savings compared to the 2008 farm bill provisions.

Senate Approves Ibach, Northey on Hold, Clovis Withdraws

Greg Ibach was sworn in as the new Undersecretary for Marketing and Regulatory Programs last week. Bill Northey still awaits Senate approval to become the next Undersecretary for Farm Production and Conservation. Senator Ted Cruz (R-TX) has placed a hold on his nomination. The hold does not appear to have anything to do with Mr. Northey but rather Senator Cruz is upset with assurances the Trump Administration recently made to Midwestern legislators with regard to Renewable Fuels Standards (RFS) policy. Finally, Sam Clovis withdrew his nomination to be the Undersecretary for Research and Science at USDA.

ABA Survey: Farm Profitability Remains Down but Fewer Lenders Report Declines

Farm profitability continued to decline in the first half of 2017, according to the latest agricultural lenders survey conducted by the American Bankers Association and Farmer Mac. While the overwhelming majority of ag lenders — 82 percent — reported declines in profitability, that figure was down seven points from six months before. The approval rate for ag loans was 84 percent.

“We were encouraged to see that lenders remain ready to assist farmers and fulfill their credit needs despite the drag in the agricultural economy,” said Brittany Kleinpaste, director of economic policy and research at ABA. “Overall, the data showed that agricultural lenders are a little more optimistic about what’s ahead for their customers than they were in December of 2016.”

We’re shamelessly adapting Megan Trainor’s lyrics, but when it comes to farmers and federal taxes we’re all about the effective rate, not the baseline rate found in the tax rate brackets. When House Ways and Means Chairman Kevin Brady makes public the committee’s tax bill tomorrow, it will once again be how all of the provisions interact to produce the effective tax rate that farmers pay to which we pay attention.

There are three main factors that have an impact how farmers are impacted by the federal tax code. The first is that most farms file through the individual code, not the corporate code. The second is that the vast majority of the average farm’s assets are tied up in illiquid long-term assets. The third is that farm income is predictability unpredictable.

Recent Iowa Land Sales Could Indicate Increasing Values

Farmers remain the top buyers of farmland and a few recent sales in Iowa show farmland values could soon be on the rise.

Last week in Story County, a 787-acre parcel of land was sold for an average of $10,770 dollars an acre, nearly $1,000 more than what the realtor expected for the ground in central Iowa.

A sale in Plymouth County in the northwestern corner divided the land into two tracts. The first 40 acres cashed in at $15,200 per acre while the left over 157 acres was sold for $14,600 an acre.

Comparing NASS and RMA County Yields for Corn

Controversy has surrounded determination of ARC-CO (Agriculture Risk Coverage county) yields. One component of this controversy is the difference in the county yields determined by NASS (National Agricultural Statistics Service) and RMA (Risk Management Agency), both U.S. Department of Agriculture units. This yield difference is examined for the 2009-2015 corn crops. While the average NASS-RMA county corn yield difference across counties and years is relatively small, large yield differences are not uncommon for a given county across years and across counties in a given year. A regression analysis finds the absolute difference in yields is statistically larger for counties with higher expected yields, higher yield variability, and a smaller share of planted acres that are insured, but is statistically smaller for counties in Midwest states. These findings are reasonable, but the regression explains only 12% of the variation in the yield differences. Controversy is thus likely to continue since a large difference that cannot be explained will lead to questions about which yield is more accurate and thus whether payments by county commodity and insurance programs are fair.

Data: NASS and RMA yields for counties, as modified by FSA, are available on the FSA website for selected crops for the 2009-2015 crop years. By statute, NASS publishes a harvested acre yield. In contrast, ARC-CO uses a planted acre yield. Thus, FSA must modify the NASS data. To calculate a NASS-based, ARC-CO yield for a county, FSA divides NASS reported production by NASS reported planted acres for all crops except corn, barley, oats, grain sorghum, and wheat. For these 5 crops, FSA modifies the calculation to exclude acres not intended for harvest as grain, such as acres for haying, grazing and silage. Specifically for the 5 crops, FSA divides NASS reported production by (NASS reported harvested acres plus RMA reported unharvested acres).

CA Growers, Organizations Share Ag Labor Struggles and Solutions

Produce growers are searching for long-term solutions not just a short-term fix when it comes to agricultural labor.

However, lawmakers and the farming community are mixed when it comes to those different solutions.
The Ag Guest worker Act, introduced by Chairman Bob Goodlatte cleared the House Judiciary Committee in late October. It’s designed to replace the H-2A Program.

That’s not the only piece of legislation floating around Congress.

Monsanto Signs Agreement With Emerging Technology Device

Two Pore Guys, a manufacturer for handheld diagnostic testing equipment, announced Monsanto’s global agreement to use the devices.

The agreement allows Monsanto to evaluate the performance of the new technology in both laboratories as well as in field conditions in detecting crops, pests, and pathogens. The handheld, single-molecule digital biosensor is as accurate as medial lab equipment but is as inexpensive and easy to use as a blood glucose monitor.

The innovative device can test for any molecule in humans, animals, plants, and the environment. The device is small and battery powered, allowing the gadget to be used in fields and reducing the costs of tests otherwise taken to labs. The device can be used to quantify GMOs and traits, do IP fingerprinting, assist in breeding, monitor pathogens, and more.

Make your commitment for Auction items today. Auction items should be shipped directly to the Westin Savannah Harbor Golf Resort and Spa to arrive no later than Tuesday, November 14, 2017. Please do not send your Auction items to arrive at the hotel more than three (3) days in advance – not to arrive before November 10, 2017 – due to the cost the hotel charges for storage.
